“OAK CLASSIC CASH” PROMOTION

HOW TO ENTER

To be eligible to enter, individuals must purchase any OAK product from participating outlets. To enter, individuals must then, during the promotional period, either:

a) visit www.oak67.com.au, follow the prompts to the competition entry page, input the requested details including the last 5 digits of the product barcode and submit the fully completed entry form; or

b) send an SMS to 19947474 with the last 5 digits of a participating product barcode, first name, last name and postcode in that order. Premium SMS cost is 55c. Entrants must have premium service access. The service provider is 5th Finger.

Entrants will be notified immediately whether or not they have won an instant prize.

TERMS AND CONDITIONS

1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

2. Entry is only open to Australian residents. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter.

3. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process (including but not limited to tampering by way of use of techniques designed to avoid the payment of SMS costs). Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

4. Incomplete or indecipherable entries will be deemed invalid.

5. Multiple entries permitted, subject to the following: (a) only one entry permitted per specified purchase requirement; (b) each entry must be submitted separately and in accordance with entry requirements; and (c) a maximum of 1 entry per person per day is permitted.

6. Entrants must retain a photocopy of their purchase receipt(s) or product barcode(s) for all entries as proof of purchase. Failure to produce proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s entries and forfeiture of any right to a prize.

7. Premium SMS cost is 55c. Entrants must have premium service access. People under 18 years of age must have bill payer’s permission. SMS winners will be contacted by SMS and/or phone and the Promoter will record their address details so that the prize may be awarded. SMS entries via the Internet are ineligible. Entries are deemed to be received at the time of receipt into the promotion database and NOT at the time of transmission by the entrant. The service provider is 5th Finger.

8. Promotion commences at 12:01am AEST on 07/07/2008. Entries close 11.59pm AEST on 11/09/2008 (“Promotional Period”). Winners will be notified immediately in writing according to their entry method: (a) SMS - via return SMS; or (b) online - upon entry submission and the winners’ names (for cash prizes only) will be published in The Australian on 07/10/2008. The Promoter’s decision is final and no correspondence will be entered into.

9. Instant win prizes will be awarded daily and hourly. Instant win daily prizes: 67 x $1,000. Instant win hourly prizes: 1608 x the winner’s choice of a beach towel valued at $25 each or a cooler bag valued at $29 each. Cash prizes will be awarded in the form of a cheque. There are a total of 1675 instant prizes to be awarded. There will be one (1) daily and one (1) hourly instant prize to be won every day and every hour of the Promotional Period. In the event that an instant prize is not awarded within a particular day or hour the instant win prize will roll over to the next day or hour. This process will continue until all prizes are awarded. In the event that all prizes have not been awarded at the end of the Promotional Period they will be distributed in the unclaimed prize draw.

10. If the winner of the $1,000 cash instant prizes is under the age of 18 years, the prize will be awarded to the winner's nominated parent or guardian.

11. Total prize pool value is $113,632. Prizes are not transferable or exchangeable and cannot be taken as cash unless otherwise specified.

12. A draw for any unclaimed prizes may take place at 11.00am AEDST on 08/01/2009 at 5th Finger, Level 7, Tower Building, Australia Square, 264 George Street, Sydney, NSW 2000, subject to any directions from a regulatory authority. The winners’ names (for cash prizes only) will be published in The Australian on 22/01/2009.

13. Quality control errors will not invalidate an otherwise valid prize claim. Unless otherwise due to fraud or ineligibility under these Terms and Conditions, all prize claims in excess of the advertised prize pool will be honoured. There will be 1675 instant win notifications produced for this promotion.

14. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

15. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.

16. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.

17. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, prize suppliers and as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period unless otherwise advised, use the information for promotional, marketing and publicity purposes including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
